All information on www.ceylor.ch (product descriptions, illustrations, films, dimensions, weights, technical specifications, accessory descriptions and other information) should be understood as approximate values only and do not, in particular, represent any assurance of characteristics or guarantees, unless otherwise explicitly noted. ceylor.ch endeavours to provide all information on this website correctly, fully, clearly and up-to-date, however ceylor.ch cannot guarantee this either explicitly or implicitly.
All offers on this website are deemed to be subject to alteration and should not be understood as binding offers.
ceylor.ch cannot give any guarantee that the products listed are available at the time of order. Therefore, all information on availability and delivery times is subject to correction and may change at any time without prior announcement.
3. Prices
Unless otherwise stated, pricing by ceylor.ch includes statutory sales tax, any prepaid recycling fees (VRG) and copyright fees for electronic devices. All prince are net, in Swiss francs (CHF).
Unless otherwise states, all shipping costs shall be calculated extra and must be paid by the customer. Shipping costs are displayed separately in the order process.
The right to technical changes, errors and misprints remains reserved, in particular, ceylor.ch may change prices at any time and without prior notice. No consultation or support services are included in the sales prices.
4. Conclusion of the contract
The offers on this website represent a non-binding invitation to the customer to order products and/or services from ceylor.ch. Upon ordering via this website, including the acceptance of these GTC, the customer makes a legally binding offer to conclude the contract. In response, celyor.ch sends an automatic “order confirmation” per e-mail, which confirms that ceylor.ch has received the customer’s offer. Orders placed are binding for the customer. Unless otherwise stated, there is no right to return or withdrawal.
The contact takes effect as soon as ceylor.ch sends an acceptance declaration per e-mail, in which the dispatch of the ordered products or services is confirmed.
Orders shall be delivered only after receipt of full payment (exception: delivery on account) and where the goods are available. Should it emerge after conclusion of the contract that the ordered goods cannot be delivered in part or in full, ceylor.ch is entitled to withdraw from the entire contract or from parts thereof. If payment by the customer has already been received by ceylor.ch, the payment will be reimbursed to the customer. Of no payment has yet been made, the customer shall be freed from the obligation to pay. In the event of the dissolution of the contract, ceylor.ch is not obliged to provide a replacement delivery.
5. Conclusion of the contract with subscriber
The first subscription box is generally dispatched within 24 hours of order receipt. Thereafter, the box will be sent each subsequent month on the 23rd day of the month. The effective delivery date may be delayed by 2-3 days. Delivery takes the form of an unregistered parcel consignment (service provider is the Swiss postal service or an alternative parcel delivery service). Upon handover of the parcel consignment from the parcel delivery service to the customer, the latter assumes responsibility for the parcel.
If you order a subscription as a gift (dispatch goes to a different person as the invoice contact), this is not renewed automatically. The subscription expires following expiry of the selected subscription period, without any further obligations.
If you order a subscription for yourself, this runs for an unlimited period. Following expiry of the selected subscription period, the subscription is extended automatically by the same period originally selected. The subscription may be cancelled up to the 10th day of the first month after the expiry of the current subscription period. If the cancellation is received at a later date, the subscription shall be extended by the subscription period selected during the order, and the cancellation applies for the next subscription period. The invoice amount is due upon the issuing of each invoice. Non-payment of the invoice is NOT equivalent to cancelling the contract. Unpaid invoices shall be subject to a written reminder, which shall also be charged. In order to complete cancellation, the customer must send an e-mail to service@doetschgrether.ch with the subject “Cancellation”, providing his name and invoice address. Subscribers are excluded from the right of return.
6. Payment options, right of ownership and reminders
Only those payment options given during the order process are available to the customer.
ceylor.ch reserves the right to exclude customers from individual payment options, or to insist on prepayment, without providing any reason.
The products delivered to the customer remain the property of ceylor.ch until full payment has been received.
Demands by ceylor.ch must be settled within 14 days. Payment reminders are subject to dunning charges at the following levels:
Reminder: no fees
Reminder: CHF 15
Reminder: additional CHF 30
The outstanding invoice amount, plus any dunning charges, may be forwarded or transferred to Intrum Justitia AG for the purpose of debt collection. Furthermore, the customer is obliged to reimburse all costs incurred by Lovehoney Group Switzerland AG or Intrum Justitia AG as a result of the payment arrears.
7. Delivery, obligation to check and returns
Deliveries shall be dispatched per post or courier service to the address given by the customer when ordering. Invoicing is done per e-mail or post. All benefits and risks are transferred to the customer upon dispatch.
If the goods cannot be delivered or if the customer refuses to accept the delivery, ceylor.ch may terminate the contract following a reprimand per e-mail to the customer and after an appropriate notice period, and may charge the customer for the costs of the inconvenience.
The customer is obliged to check the delivered goods immediately after receipt of delivery and to report in writing any defects for which ceylor.ch is liable per letter or e-mail to the address (Imprint).
Returns to ceylor.ch are made on the account and at the risk of the customer. The customer must send the goods in their original packaging, together with all accessories and including the delivery note and a detailed description of the defects to the returns address provided by ceylor.ch (Lovehoney Group Switzerland AG, Neue Winterthurerstrasse 99, 8304 Wallisellen, Schweiz).
Should emerge after examination by ceylor.ch that the goods do not display any detectable defects, or that these are not covered by the manufacturer’s guaranteed, ceylor.ch may charge the customer for the inconvenience, the returns costs, or any disposal charges.
8. Right to withdraw
The customer is granted a right to withdraw within 14 calendar days of receiving the goods. The deadline is deemed to have been met if the customer sends a written revocation per e-mail (service@doetschgrether.ch) or letter (Lovehoney Group Switzerland AG, Neue Winterthurerstrasse 99, 8304 Wallisellen, Schweiz) within the deadline to ceylor.ch. No reason must be given for withdrawal. Subscribers are excluded from the right to withdraw.
Exercising the right to withdraw leads to the unwinding of the contract. The customer must return the goods within 14 calendar days, unopened their original sealed packaging, together with all accessories and including the delivery not, to the return address provided by ceylor.ch (Lovehoney Group Switzerland AG, Neue Winterthurerstrasse 99, 8304 Wallisellen, Schweiz). Returns to ceylor.ch are made on the account and at the risk of the customer. Any payment already made will be reimbursed to the customer within 30 calendar days, provided ceylor.ch has received the good or the customer can produce proof of dispatch.
ceylor.ch reserves the right to demand appropriate compensation for any damages, unreasonable use or loss in value die to improper treatment, and to deduct the amount from any purchase payments already made, or to invoice these costs to the customer.
No right of withdrawal is granted in the following cases:
(I) If the contract contains a random element, namely because the price is subject to fluctuations, on which the provider has no influence.
(II) If the object of the contract is a moveable item that is not suitable for return due to its nature, or which can spoil quickly;
(III) If the object of the contract is a moveable item that has been produced in accordance with the demands of the consumer or which is clearly tailored to personal requirements;
(IV) If the object of the contract is digital content and this content is not made available on a physical medium, or if the contract must be fulfilled completely by both parties immediately;
(V) If the object of the contract is a service and the contract must be fulfilled completely by the provider with the prior express consent of the consumer, before the revocation period has expired.
9. Warranty
ceylor.ch endeavours to deliver goods in faultless condition. In the event of defects reported in a timely manner, ceylor.ch shall assume the warranty for the freedom from defects and functionality of the goods purchased by the customer during the legal warranty period of, in general, two years from the date of delivery. ceylor.ch is entitled to decide whether the warranty shall be provided in the form of free repair, replacement with an equivalent, or reimbursement of the purchase price. All other claims are excluded.
The warranty does not cover normal wear and tear, or the consequences of improper treatment or damages by the customer or third parties, as well as defects that are ascribable to external circumstances. Also, no warranty is given for consumable or expendable parts (e.g. batteries).
It is not possible for ceylor.ch to guarantee or assure the actuality, completeness or correctness of the data, or the constant, uninterrupted availability of the website, its functions, hyperlinks or other content. In particular, no guarantee or assurance is given that the use of the website will not breach any third-party rights not owned by ceylor.ch.
10. Liability
ceylor.ch rules out all liability, irrespective of the legal reason, as well as compensation claims against ceylor.ch and any ancillaries or vicarious agents. In particular, ceylor.ch is not liable for indirect damages or consequential damages, lost profit or other personal, material or purely financial damages incurred by the customer. An extended mandatory legal liability, for example for gross negligence or criminal intent, remains reserved.
ceylor.ch uses hyperlinks solely for ease of access for the customer to other web offers. ceylor.ch cannot know these web offers in detail, nor can it assume any liability or responsibility for the contents of these websites.
